Privacy Notice

Effective 28 August 2026. This notice describes how Gaucho Australis (“we”, “us”) handles personal data when you use www.gauchoaustralis.com or engage us as a consultant or implementer.

1. Who we are

When we design or operate a client’s cameras, VMS, or AIoT platform, the client is typically the controller of operational video and sensor data. We act as processor / service provider under a statement of work and a data-processing addendum.

2. Data we collect on this website

Identity and contact data you send through the form or email (name, work email, organization, message).
Technical data: IP address, browser type, pages viewed, approximate location derived from IP, and standard server logs.
Communications data if you write to us or book a call.

We do not require an account to read this site. We do not sell personal information.

3. Operational video, sensors, and AI (client projects)

Video AIoT, mobility, and safe-city programs can involve images of people, vehicle plates, location traces, and — only if a client expressly commissions it — biometric templates. Those categories are treated as high-risk.

We do not use client operational video to train general-purpose models unless the contract says so in writing.
Retention, access roles, and audit logs are defined with the client before go-live.
Biometric identification, emotion inference, and unlawful mass surveillance are out of scope unless a lawful mandate and DPIA exist.
Default design: data minimization, purpose limitation, edge inference where it reduces transfer of identifiable video, and policy-aware retention.

4. Purposes and legal bases (EU / UK GDPR)

Respond to inquiries and perform a contract — Art. 6(1)(b).
Legitimate interests — site security, B2B relationship management, improving the public website — Art. 6(1)(f).
Legal obligation — tax, accounting, lawful requests — Art. 6(1)(c).
Consent — non-essential cookies or optional marketing, if we ever add them — Art. 6(1)(a). You may withdraw consent at any time.

Special-category data (including biometric data used to uniquely identify a person) is processed only with a GDPR Art. 9 condition and, where required, a data-protection impact assessment.

5. United States

If you are a California resident, the CCPA/CPRA applies to personal information we collect as a business. In the last 12 months we may collect identifiers, commercial information (inquiries), and internet activity from the website. We do not sell or “share” personal information for cross-context behavioral advertising. We do not use or disclose sensitive personal information to infer characteristics from website use.

California rights: know, delete, correct, and opt out of sale/sharing. We will not discriminate for exercising those rights. Submit requests to info@gauchoaustralis.com. We will verify the request and respond within the statutory period. You may use an authorized agent.

Other US state privacy laws (Colorado, Virginia, Texas, and similar) are honored on the same request channel. Public-sector clients remain responsible for CJIS, FOIA, and local surveillance ordinances that apply to their camera programs.

6. Latin America

Argentina (Law 25.326 and AAIP rules). Data is processed with the owner’s consent or another lawful exception (contract, legal duty, legitimate interest consistent with AAIP guidance). Owners may access, correct, and suppress data. Complaints: Agencia de Acceso a la Información Pública (AAIP).
Brazil (LGPD). Processing bases include consent, contract, legal obligation, legitimate interest, and protection of life or physical safety where relevant to emergency systems. Data subjects may access, correct, anonymize, port, and revoke consent. Complaints: Autoridade Nacional de Proteção de Dados (ANPD).
Mexico (LFPDPPP). ARCO rights (access, rectification, cancellation, opposition) may be exercised at info@gauchoaustralis.com.
Other LATAM jurisdictions: we apply the same access/correction/deletion channel and the stricter rule where two laws overlap on a single processing activity.

7. International transfers

We operate between Argentina and the United States and may use processors in the EU, UK, or other countries (email, hosting, collaboration tools). Where GDPR restricted transfers apply, we use the European Commission Standard Contractual Clauses (and UK Addendum where needed), plus transfer assessments. Argentina–US flows follow AAIP transfer rules and contractual safeguards.

8. Retention

Inquiry records: typically 24 months after last contact, unless a contract or claim requires longer. Server logs: up to 90 days. Client operational data: the period in the statement of work, then return or deletion. Backup media follow a short residual cycle.

9. Security

Access control, encryption in transit, least-privilege administration, vendor review, and incident notification consistent with GDPR Art. 33/34, LGPD, and applicable US breach statutes. No method is perfect; we will notify you and regulators when the law requires it.

10. Cookies

This static site does not set advertising cookies. If we later add analytics, we will update this notice and, where GDPR/ePrivacy require it, request consent for non-essential cookies.

11. Children

The website is directed at organizations, not children. We do not knowingly collect data from children under 16 (or the higher age set by local law).

12. Your rights — how to exercise them

Email info@gauchoaustralis.com with the subject “Privacy request”. State the right you want to exercise and the country you are in. We may need to verify identity. You may lodge a complaint with your supervisory authority (for example ICO, an EU DPA, AAIP, ANPD, or a US state attorney general) if you believe we have not handled your data lawfully.

13. Changes

We will post updates on this page and change the effective date. Material changes to how we use operational video will also be reflected in client contracts.
